Policy 501 - Student Disability Nondiscrimination

The purpose of this policy is to protect disabled students from discrimination on the basis of disability and to identify and evaluate learners who, within the intent of Section 504 of the Rehabilitation Act of 1973 (Section 504), need services, accommodations, or programs in order that such learners may receive a free appropriate public education. 

A.  Learners may be protected from disability discrimination and be eligible for services, accommodations, or programs under the provisions of Section 504 even though they are not eligible for special education pursuant to the Individuals with Disabilities Education Act.

B.  Section 504 Students who have a diagnosed medical condition identified to be a disability may be eligible for certain protections under Section 504 of the Rehabilitation Act of 1973.  Schools are required to provide access to education for all students and to make available reasonable accommodations and/or modifications to a child’s educational program or setting.  If a student is eligible for protection under Section 504, a Section 504 Plan will be developed by the child’s team including parents, child (if appropriate) and other knowledgeable personnel. 

C.  The responsibility of the school district is to identify and evaluate learners who, within the intent of Section 504, need services, accommodations, or programs in order that such learners may receive a free appropriate public education.

D.  People who have questions, comments or wish to make a compliant regarding a disability discrimination matter should contact the building principal, the school district’s human rights officer (Executive Director of Human Resources) or the school district’s Americans with Disabilities Act/Section 504 coordinator (Director of Special Services.).
